Swadaara

Terms and Conditions

Effective as of May 2026

Overview

This digital storefront is owned and managed by Swadaara. Throughout this portal, the markers "we", "us", and "our" refer explicitly to Swadaara. We present this website, housing all embedded toolsets, information collections, and transactional features to you, the user, contingent on your formal verification and acceptance of all terms, conditions, declarations, and notices mapped within this document.

By browsing our digital collections or purchasing a handloom product from our platform, you interact with our "Service" and agree to be contractually bound by the following Terms and Conditions. These rules apply uniformly to all site visitors, including standard browsers, direct buyers, independent merchants, or media contributors.

Please review these Terms closely before navigating or checking out from our web application. By accessing any section of this site, you acknowledge your consent to be governed by these provisions. If you do not agree with any phrase or condition detailed here, you should immediately halt your browsing session and exit the site.

Any additional inventory features, artisan updates, or checkout frameworks added to our store layout will naturally fall under the governance of these Terms. We retain the right to edit, update, or substitute any component of these Terms by publishing updates here. It remains your responsibility to track modifications periodically.

1. Legal Status of This Document

This document constitutes an authenticated electronic record formulated in compliance with the Information Technology Act, 2000 along with relevant statutory amendments concerning electronic logs across various frameworks. This digital file is compiled by an automated computing network architecture and requires no physical or digital hand signatures.

This layout is published and maintained strictly in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2011, which dictates the public accessibility of functional operational rules, site privacy guidelines, and user terms for web-based portal interactions.

2. User Eligibility

Browsing and executing transactions on this digital catalog is intended solely for individuals who have attained at least 18 years of age, or the legal age of majority in your jurisdiction. By exploring our collections or checking out a product, you declare that you satisfy this legal eligibility threshold. Minors may access the catalog only under the direct supervision of a parent or authorized legal guardian who consents to be legally bound by this structure.

If we detect that an account has been opened by an unsupervised minor below the age of consent, we reserve the right to suspend or close the profile immediately. If you have questions or concerns regarding user verification, please email us at support@swadaara.com.

Individuals accessing this storefront from international regions outside India assume full liability for aligning their site usage with native local laws alongside applicable Indian legal frameworks.

3. Account Maintenance & Registration

To access specific customized features or look at your purchase ledger, you may need to establish a dedicated customer profile. You agree to submit input parameters that are entirely factual, current, and exhaustive, and to instantly adjust your logged details if your coordinates shift.

If you submit fraudulent, outdated, or partial shipping or profile properties, or if Swadaara holds reasonable grounds to doubt the authenticity of your submission, we maintain the explicit right to suspend or block your platform access indefinitely. If a delivery misroutes due to incomplete details supplied by the customer (such as an incorrect pin code or flat number), all associated reverse logistics and re-shipping fees will be billed to your account.

4. Electronic Communications

By engaging with our platform or transmitting support tickets, you acknowledge that your interactions with us are executed via electronic mediums. You express your consent to receive transactional and operational records from us via email, SMS, phone calls, or digital messaging spaces like WhatsApp. These messages will clear up order confirmations, shipping logs, and promotional updates regarding our upcoming weaver drapes.

5. Accuracy, Exhaustiveness & Timeliness of Content

While we work closely with artisan clusters to compile accurate stories, we do not accept liability if material made public on this site contains occasional layout delays or partial descriptions. The site content is presented for general informational viewing and should not be used as the definitive foundation for choices without consulting primary textile sources.

Our platform may include typographical errors, clerical discrepancies, or out-of-date product descriptions connected with saree specifications, pricing grids, dynamic promotional values, or shipping estimates. We hold the right to remedy any descriptive error and to modify, update, or cancel affected orders without prior warning, including after an order request has been submitted.

6. Handloom Product Profiles & Variations

We take deep care to catalog the colors, textures, and zari properties of our handloom sarees as accurately as possible on our display screens. However, because digital screens alter display outputs differently, we cannot guarantee your individual monitor will perfectly match the dynamic true color of the received textile fabric.

As authentic handwoven products, every saree features unique characteristics. Subtle variations in weave loops, thread density, or natural dye depths are classic signatures of genuine handloom production and are not treated as defects. Saree storage packaging patterns may alter over time depending on structural requirements. We reserve the authority to limit product delivery volumes or split up orders across distinct logistics batches when necessary.

7. Pricing Structure & Payment Processing

All catalog valuations are calculated in Indian Rupees (INR) and incorporate built-in Goods and Services Tax (GST) allocations unless indicated otherwise. Applicable distribution or custom finishing fees (like fall/picot stitching) are computed during checkout sessions. Payments are handled via securely encrypted third-party interfaces.

Our gateways accept major international and domestic cards (Visa, MasterCard, American Express) along with authorized digital payment modes. Product values may adjust over time to account for changing raw yarn or metal zari pricing structures. In the event of a severe pricing configuration error, we retain the right to decline or cancel the purchase order. International custom clearances, local border tariffs, and regional handling taxes are handled entirely by the customer.

8. Order Acceptance Protocol

The display of textiles on our digital storefront serves as an invitation to offer. Your checkout selection represents a formal purchase offer governed entirely by these Terms. Our formal contract acceptance occurs only when your ordered package is cleared and handed over to our shipping carriers.

Dispatches containing multiple items may be split across separate consignments. In those circumstances, only the specific subset of items confirmed via dispatch tracking is accepted into our fulfillment contract. No platform update or payment hold occurring prior to real parcel dispatch shall form an explicit acceptance of your offer.

9. Logistics & Shipping Terms

All shipments are handled in coordination with our separate Shipping Policy. Domestic delivery routines typically range between 2 to 7 business days depending on location and local weaver cluster allocations.

For standard collections, requests for cancellations or corrections must be sent to our care desk on the same calendar day your purchase was initiated. Once a saree package leaves our fulfillment hubs, no alterations or cancellations can be processed.

10. Return, Refund & Exchange Framework

All returns and refunds are governed strictly by our separate Return & Refund Policy. Issues regarding structural damage or processing anomalies must be raised within our dedicated return window.

⚠  Mandatory Document: A comprehensive, continuous, and unedited unboxing video is an absolute necessity to authorize any return or exchange claim. Requests submitted without valid video evidence will be rejected without assessment.

11. Cancellation Guidelines

Swadaara maintains the absolute privilege to decline or cancel any order request at our discretion. Common grounds for order cancellation include banking validation failures, suspected bulk reseller activity, typographical pricing issues, or unexpected thread/inventory shortages within a specific weaving group. If an order is canceled after payment processing, the complete balance will be automatically routed back to your source account.

12. Sales, Promotions & Seasonal Exhibitions

All special promotional activities on this portal are governed by the following rules:

  • Promotional pricing applies strictly while curated stocks last. Swadaara preserves the freedom to adjust or terminate a sale period without notice.
  • Discounted tags or specific promotional entries may be removed, added to, or altered at our discretion.
  • Coupons distributed via specialized electronic channels cannot be stacked or combined with independent offline exhibition offers.
  • Any product returns linked to promotional campaigns will be assessed under the guidelines of our Return & Refund Policy.

13. User Conduct Obligations

As a user of Swadaara, you pledge to adhere to the following behavioral standards:

  • Supply true, verified, and updated information whenever prompted by our input channels.
  • Carefully review the distinct handloom attributes of a saree before completing your payment. By checking out, you accept the specific conditions of sale tied to that product description.
  • Refrain from executing any automated data-mining, scrapers, crawlers, or unauthorized entry routines into the core server infrastructure.
  • Do not replicate, duplicate, forge, sell, or exploit any operational aspect of our Service or imagery without explicit written authorization from our management team.

14. Prohibited Uses

You are prohibited from using the site or its content for any unlawful purpose, to infringe upon our intellectual property or the rights of others, or to submit false or misleading information. You must not upload viruses or malicious code, collect or track the personal information of others, or spam, phish, crawl, or scrape the site. We reserve the right to terminate your use of the Service for violating any prohibited uses.

15. User Submissions & Profanity Restrictions

If you submit ideas, reviews, or feedback, you grant Swadaara an unrestricted right to edit, reproduce, and share those materials across our channels. We are not obligated to pay compensation or maintain submissions in confidence. We reserve the right to moderate or delete any content we deem unlawful or offensive.

Profanity Policy

Swadaara strictly prohibits the use of aggressive, abusive, or obscene expressions within reviews, profile fields, or communication lines. Violating this standard will result in an immediate block of your user account privileges.

16. Data Privacy Protection

Protecting your personal information is a core priority. The collection and processing of your personal data through this website are governed by our Privacy Policy. We store and manage your details on secure servers using industry-standard protective frameworks in compliance with the Information Technology Act, 2000.

17. Third-Party Integrations & Tools

We may provide access to optional third-party tools (such as live chat or tracking features) over which we have no direct control. These integrations are provided "as is" and "as available" without warranties of any kind. Any use of these optional tools is entirely at your own risk and discretion.

18. External Links

Our platform may contain links redirecting you to third-party platforms not affiliated with us. We do not assume responsibility for examining or verifying the content, safety, or accuracy of these external sites, and we are not liable for any transactions made on third-party websites.

19. Service Availability & Delivery Adjustments

We reserve the right to refuse service or limit product quantities per individual, household, or order at our sole discretion. This includes orders placed under the same customer profile, identical credit cards, or matching delivery addresses. We also reserve the right to prohibit purchases that appear to be placed by dealers, resellers, or commercial distributors.

20. Platform Security Violations

You are strictly prohibited from compromising the security of this website. This includes attempting to access unauthorized server data, probing system vulnerabilities, spreading malicious software, or interfering with network routing. Violations of system security may result in civil or criminal liabilities, and Swadaara will cooperate fully with law enforcement to investigate such actions.

21. Intellectual Property & Copyright Protection

Swadaara, along with its specialized artisan licensors, holds the exclusive copyright and intellectual property rights for all content on this website. This includes logos, saree imagery, graphic designs, product descriptions, video loops, and underlying software code. Access to this platform does not transfer any right, title, or interest in these materials to the user.

22. Disclaimer of Warranties

We do not guarantee or warrant that your use of our platform will be uninterrupted, completely secure, or error-free. The website and all items delivered to you are provided "as is" and "as available" for your use, without any representations or implied warranties of merchantability, fitness for a particular purpose, or durability.

23. Limitation of Liability

In no case shall Swadaara, our directors, partners, employees, or artisan suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind. This includes lost profits, revenue loss, or replacement costs arising from your use of our services or products. In jurisdictions that do not allow the exclusion of liability, our responsibility shall be limited to the maximum extent permitted by law.

24. Legal Indemnity

You agree to indemnify, defend, and hold harmless Swadaara, our subsidiaries, partners, and employees from any third-party claims, legal demands, or penalties arising from your breach of these Terms and Conditions, your violation of any law, or your infringement of intellectual property rights.

25. Provision Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall nonetheless be enforceable to the fullest extent permitted by law. The unenforceable portion shall be deemed severed from these Terms, and this determination will not affect the validity of the remaining provisions.

26. Term Separation & Termination

The obligations and liabilities incurred by the parties prior to the termination date shall survive the termination of this agreement. You may terminate these Terms at any time by notifying us in writing that you no longer wish to use our services, provided you discontinue any further use of our website.

27. Entirety of Agreement

These Terms, along with our published operational policies, constitute the complete agreement and understanding between you and Swadaara, superseding any prior agreements or communications. Any ambiguity in interpreting these provisions shall not be construed against the drafting party.

28. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the applicable laws of the Republic of India. The courts at Bangalore, Karnataka shall hold exclusive jurisdiction over any legal proceedings arising out of or in connection with these Terms.
